The memorandum opinion and order is Document 113 in ABC IP, LLC v. AS Designs, LLC, Civil No. 4:26-cv-370, in In re: Rare Breed Triggers Panel Litigation, No. 4:26-md-03176 (E.D. Tex.), signed October 20, 2026 by Judge Amos L. Mazzant. The plaintiffs are ABC IP, LLC and Rare Breed Triggers, Inc. The defendants are AS Designs, LLC, Matthew S. Karlovic, Calvin Olson, and a John Doe defendant. The case began in the Middle District of North Carolina, where the complaint was filed December 30, 2025 as No. 1:25-cv-1192. The court heard argument on October 15, 2026.
Patents and products
The asserted patents are U.S. Patents 12,038,247, 12,031,784, 12,529,538, 12,578,159, and 12,636,403. Before the TRO motion, the plaintiffs named AS Designs' Super Safety and ARC-Fire products. The TRO motion, filed September 2, 2026, sought to stop the launch of the ARHK, which the plaintiffs say is built on the ARC-Fire and repackages that technology for the HK platform. The order says the ARHK was announced at the SHOT Show in January 2026 and had not launched when briefing closed.
Motion to strike denied
The defendants moved to strike because the ARHK is not pleaded. The court held the third amended complaint's request to enjoin infringement of the asserted patents is not limited to the ARC-Fire and Super Safety, and that the deadline for infringement contentions under Local Patent Rule 3-1(b) has not passed, so the plaintiffs may continue to identify and accuse products.
TRO denied
The plaintiffs relied on an expert's claim charts of the ARC-Fire and on AS Designs' description of the ARHK as "built on [its] ARC-Fire technology," and acknowledged they had not inspected a physical product or engineering drawings. The court held that, without a product or specifications, they had not met their burden on the merits factor, and did not reach the other three factors. The TRO was denied without prejudice.
