The complaint

The case is All Packaging Company LLC v. STIIIZY Inc., No. 2:26-cv-12527 (C.D. Cal.), filed October 26, 2026. All Packaging Company LLC is a Delaware limited liability company based in Aurora, Colorado. The complaint says All Packaging designs and manufactures child-resistant paperboard packaging, including its LeafLocker line. The defendants are STIIIZY Inc., formerly known as Shryne Group, Inc., a Delaware corporation based in Los Angeles, California, and STIIIZY IP LLC, formerly known as STIIIZY, LLC, a California limited liability company also based in Los Angeles. The complaint also names Does 1 through 10 as manufacturers, suppliers, or distributors of the accused packaging, including, All Packaging alleges on information and belief, entities from which the STIIIZY defendants buy or import products. Venue is pleaded under 28 U.S.C. 1391(b)-(c) and 1400(b) on the ground that the STIIIZY defendants reside in the district, have committed acts of infringement there, and have a regular and established place of business there. The complaint is signed by Russell J. Gould of White & Case LLP and also lists Gregory M. Starner, Mariel Radek, Aditi Padmanabhan, and Michael J. Songer of the same firm.

The patent

U.S. Patent 11,628,990 is titled "Locking Packaging Container," lists Christopher Chambers as inventor, and issued April 18, 2023. The complaint alleges that All Packaging Company LLC owns all right, title, and interest in the patent, including the right to sue. The patent names All Packaging Company of Aurora, Colorado as assignee, and USPTO assignment records list a change of name from All Packaging Company to All Packaging Company LLC, effective February 5, 2021 and recorded July 6, 2022 (Reel/Frame 60613/0901). The complaint alleges infringement of one or more claims and says Exhibit 2 charts an accused product against a representative claim. Exhibit 2 is not publicly available.

U.S. Patent 11,628,990 covers a packaging apparatus with an outer sleeve, an inner sleeve, and locking mechanisms that lock the inner sleeve inside the outer sleeve. Independent claim 1 requires a first locking mechanism in which a locking tab on the inner sleeve moves from a position between the inner sleeve's bottom panel and the outer sleeve's middle panel into an angled position and engages a locking ridge on the middle panel, and a second locking mechanism in which the locking tabs of the inner and outer sleeves, angled in opposing directions, latch as the inner sleeve slides out.

The accused products and notice

The complaint accuses child-resistant packaging containers used for STIIIZY-branded vape pod products. It alleges that STIIIZY has purchased All Packaging's packaging since about September 2018, that All Packaging was a preferred packaging supplier, and that, on information and belief, the defendants used knowledge from that relationship to copy the design and have Does manufacture the accused products in place of All Packaging's packaging. It alleges the accused products are virtually identical to packaging All Packaging previously supplied. It further alleges that STIIIZY, through a related corporate entity, has imported paperboard packaging boxes from a supplier in Shanghai as recently as August 13, 2026, and has used other suppliers to import such boxes.

All Packaging alleges notice under 35 U.S.C. 287 through marking its own packaging with a website that published patent information, a May 19, 2026 letter informing STIIIZY that it was infringing the '990 patent, and notice of the complaint. Count I alleges direct infringement under 35 U.S.C. 271(a) by the STIIIZY defendants and the Doe defendants, and induced infringement under 35 U.S.C. 271(b), alleging on information and belief that STIIIZY induced the Does to make and supply the accused packaging. The complaint alleges, on information and belief, that the infringement has been and continues to be knowing and willful.

The relief sought

All Packaging asks for a judgment of infringement, a judgment of willful infringement, damages with interest and costs under 35 U.S.C. 284, enhanced damages under section 284, a preliminary and permanent injunction under 35 U.S.C. 283, an exceptional-case finding and attorneys' fees under 35 U.S.C. 285, and costs and expenses. It demands a jury trial.

Related litigation

On the day it filed the patent complaint, All Packaging filed a notice of related case identifying All Packaging Company LLC v. Stiiizy Inc., No. 2:26-cv-01526 (C.D. Cal.), a contract action All Packaging filed against Stiiizy Inc. on February 12, 2026, under the court's diversity jurisdiction. The docket in that case shows assignment to District Judge Cynthia Valenzuela and Magistrate Judge Pedro V. Castillo.
