The complaint
The case is Congruent Media Resourcing LLC v. Trustwise Inc., No. 7:26-cv-00432 (W.D. Tex.), filed October 22, 2026 in the Midland-Odessa Division and assigned to Judge David Counts. Congruent Media Resourcing is a Texas limited liability company based in Austin. The complaint alleges, on information and belief, that Trustwise is a Delaware corporation with its U.S. headquarters in Austin, and pleads venue under 28 U.S.C. 1400(b). It is signed by Steven G. Kalberg of Direction IP Law and also lists David R. Bennett.
The patent
U.S. Patent 9,135,418, "System and Method for Creating Secure Applications," issued September 15, 2015. Claim 1 covers a method of operating a secure application that was created from a target application by imposing a second set of functions, with a second application behavior, on the target application's first set of functions: on a request to activate the secure application, the method forces it to override the first behavior with the second, which takes priority, and performs the second behavior through a processing unit. The complaint asserts claims 1 to 4 and alleges Congruent is the assignee of all right, title, and interest in the patent.
The accused product
The complaint alleges, on information and belief, that Trustwise directly infringes by using the Trustwise AI Control Tower, which it describes as providing run-time guardrail protection for AI applications through real time, inline monitoring, control, and governance. It also alleges induced and contributory infringement from at least the date of service of the complaint. Because only method claims are asserted, the complaint says the marking requirement of 35 U.S.C. 287(a) does not apply.
The Fortinet suit
Congruent filed Congruent Media Resourcing LLC v. Fortinet, Inc., No. 2:26-cv-00952 (E.D. Tex.), on the same day. The docket lists the '418 patent as the complaint's exhibit, and the case is assigned to Judge Rodney Gilstrap.
The relief sought
Congruent asks for a judgment of infringement, damages, a preliminary and permanent injunction, and pre-judgment and post-judgment interest. Congruent demands a jury trial.
What to watch next
Watch for service and Trustwise's answer or Rule 12 motion, a motion to transfer from the Midland-Odessa Division, and Fortinet's response in the Eastern District of Texas.
