Under eBay v. MercExchange, a permanent injunction requires irreparable injury, inadequacy of monetary remedies, a balance of hardships supporting relief, and consistency with the public interest. The court applies those factors to the evidence; neither a general rule granting injunctions nor a categorical rule denying them to licensors is appropriate.

How is preliminary relief different?

Winter v. Natural Resources Defense Council requires likely success on the merits, likely irreparable harm without early relief, favorable equities, and the public interest. A request before trial therefore needs evidence on both the underlying claim and the need for immediate relief. The title or size of the plaintiff does not answer those questions.

What should the business team read?

Read the proposed or entered order itself. Rule 65(d) requires specificity about the acts restrained; Rule 65(c) addresses security for preliminary relief. Map the order to products, conduct, and timing with counsel instead of relying on a headline that says a company has been enjoined.
