What must the venue analysis establish?
For a patent infringement action, section 1400(b) permits venue where the defendant resides or where it committed acts of infringement and has a regular and established place of business. TC Heartland v. Kraft Foods limits a domestic corporation's residence to its state of incorporation for this purpose. A particular district and corporate form still need their own analysis.
What should I compare among proper districts?
Compare relevant witnesses, documents, operations, related proceedings, and local case-management requirements. Section 1404(a) permits convenience transfer subject to its requirements. A preferred timetable does not eliminate a transfer issue, and a timetable should come from current court information rather than an unsupported reputation.
Does the same rule cover every defendant?
Do not apply the domestic-corporation holding mechanically to every entity. Section 1391(c)(3) separately addresses defendants not resident in the United States. Identify the actual legal entity, its locations, and the asserted conduct before choosing a forum.
