The parties and the patent

The case is Flycatcher Corp. Ltd. v. Futurpals Co. Limited, No. 2:26-cv-11817 (C.D. Cal.). The complaint describes Flycatcher as a United Kingdom company that makes the smART Sketcher 2.0 and smART Sketcher AI drawing projectors for children, and Futurpals as a Chinese company based in Shenzhen. The patent is U.S. Patent 12,688,791, Interactive Educational Electronic Toy System. The complaint says Flycatcher's smART Sketcher projectors are covered by the patent and that the Yoture projector competes directly with them.

What the patent covers

Claim 1 covers a system that presents a drawing or writing challenge step by step. It requires a housing with physical buttons including a next-step button, a projector in the housing that projects each challenge step onto a surface in sequence, and a controller with stored instructions that receive a selected challenge made of steps with lines or curves, process it for the projector, projection surface, or ambient conditions, project the first step, and project the next step when the next-step button is pressed.

What the complaint alleges

The accused product is the Yoture AI drawing projector, also called the Bright Buddies projector, used with the Yoture or BrightBuddies app. The complaint says it is sold on yoturetoys.com and on Amazon under ASIN B0FSJ58P6N. For personal jurisdiction, the complaint quotes the Yoture website as saying orders ship from a Los Angeles warehouse and pleads Federal Rule of Civil Procedure 4(k)(2) in the alternative. It alleges direct infringement of at least claim 1 and induced and contributory infringement under 35 U.S.C. 271(b) and (c), with knowledge pleaded from the filing of the complaint. The claim chart is a filed exhibit.

Relief requested

Flycatcher asks for damages; a preliminary and permanent injunction ordering Futurpals to stop infringing and "to take down all offerings of the infringing product"; costs, expenses, and pre-judgment and post-judgment interest; a willfulness finding with enhanced damages up to treble; and attorneys' fees under 35 U.S.C. 285. The willfulness request appears only in the prayer, and the body of the complaint dates Futurpals's knowledge of the patent to "at least the filing of this Complaint." The complaint demands a jury trial.

What to watch next

Watch for service on the Chinese defendant, any preliminary injunction motion, and whether the Amazon listing changes while the case is pending.
