The complaint
Intake Breathing Technology, LLC v. Sahak Group LLC, No. 1:26-cv-02975 (E.D. Va.), is a ten-page complaint for patent infringement filed September 9, 2026, ECF No. 1, with a jury demand. Intake, a California limited liability company based in Santa Barbara, alleges, on information and belief, that Sahak is a Virginia limited liability company that operates an Amazon store under the Sahak brand. The accused products are nasal strip refill tabs sold on Amazon under a listing titled in part Nasal Strips Refill Tabs Pack (60 Count).
What the patent covers
U.S. Patent 9,510,969 is titled Nasal element for a breathing system and issued December 6, 2016. Claim 1 covers a disposable apparatus that attaches to a wearer's nose for use with a nearby magnet: a flexible base layer with adhesive on one surface, a metallic element on the other surface that interacts with the magnet to impart a dilating force on the nose, and an outer layer over the metallic element, with part of the base layer extending beyond the metallic element as a flexible peripheral portion, the metallic element allowing the magnet to move relative to it, and the apparatus switching between an active state, in which the dilating force is applied, and an inactive state, in which the metallic element is magnetically decoupled from the magnet.
What the lawsuit is about
Intake alleges that the accused refill tabs meet each limitation of at least representative claim 1, attaching a claim chart as Exhibit 3, and that they are designed to mimic its own nasal adhesives, which it sells with a magnetic band and applicator as a nasal dilator system. It alleges that Sahak has had notice of the patent at least since mid-August 2026, when Intake filed an Amazon APEX takedown against the listing. The prayer asks for temporary, preliminary, and permanent injunctions, damages, an award of profits, interest, and attorneys' fees.
