The case is Intent IQ, LLC v. Zeta Global Corp., No. 1:26-cv-01340 (D. Del.), filed October 16, 2026. Intent IQ is represented by Farnan LLP and Russ August & Kabat and demands a jury.

The patent and accused products

U.S. Patent 8,677,398, titled "Systems and methods for taking action with respect to one network-connected device based on activity on another device connected to the same network," issued March 18, 2014. Google Patents lists an adjusted expiration date of May 1, 2027. The accused products are the Zeta DSP, including optimization algorithms and predictive signals such as Live Clicker that the complaint says use household identity associations, and the Zeta Marketing Platform, including bid enrichment and attribution based on household linkages.

What the patent covers

Claim 13 covers a method, implemented with a programmed hardware computer system, of automatically causing an action to be taken with respect to a second device based on electronic profile data associated with a first device's identifier, where the second device's identifier is electronically associated with the first device's identifier because each device, independently, connected to a common local area network before the action, and the computer system connects to that network through the Internet but is not part of it.

What the lawsuit is about

The complaint alleges, on information and belief, that the accused products directly infringe by performing the patent's method claims, charts claim 13 in Exhibit 3, alleges that Zeta induces its customers and partners to perform the method under 35 U.S.C. 271(b), and pleads contributory infringement under 35 U.S.C. 271(c). It alleges willful infringement, and that Zeta has known of the patent since correspondence dated August 18, 2026. Because only method claims are asserted, the complaint says the marking requirement of 35 U.S.C. 287 does not apply.

Relief sought

Intent IQ asks for damages of no less than a reasonable royalty, a permanent injunction, an accounting and supplemental damages, and attorneys' fees under 35 U.S.C. 285.
