The Commission published a notice of receipt of complaint for DN 3937 on September 24, 2026. UnaliWear, Inc. filed the complaint and a section 210.8(b) public-interest submission on September 21, 2026.
The complaint alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain wearable activity and health monitoring devices and systems containing same.
Named respondents are Samsung Electronics Co., Ltd. of South Korea; Samsung Electronics America, Inc. of Ridgefield Park, New Jersey; Google LLC of Mountain View, California; Garmin Ltd. of Switzerland; Garmin International, Inc. of Olathe, Kansas; and Garmin USA, Inc. of Olathe, Kansas.
UnaliWear requests a limited exclusion order, cease and desist orders, and a bond on alleged infringing articles during the 60-day Presidential review period.
The receipt notice does not list the asserted patents; the public version of the complaint is on the Commission's EDIS docket. UnaliWear filed district court cases on December 12, 2025 against Samsung (E.D. Tex. No. 2:25-cv-01214), Google (W.D. Tex. No. 7:25-cv-00571), Apple (W.D. Tex. No. 7:25-cv-00570), and Garmin (C.D. Cal. No. 2:25-cv-11772). The Samsung complaint asserts U.S. Patents 10,051,410 and 10,687,193, which it describes as covering wearable devices with activity tracking, including automatic fall detection. Apple is not named in the ITC complaint, and the receipt notice does not say whether the ITC complaint asserts the same patents.
Receipt of a complaint is not institution. The Commission is soliciting public-interest comments under its rules; written submissions on the public interest are due eight calendar days after Federal Register publication.
