The complaint

The case is KISS Nail Products, Inc. v. Ardell International, Inc., No. 2:26-cv-11118 (C.D. Cal., Western Division), a 37-page complaint filed September 25, 2026, ECF No. 1, with a jury demand. KISS filed a notice of related case identifying No. 2:25-cv-02793 (ECF No. 5), which the complaint describes as its earlier suit against Ardell on U.S. Patent 12,171,288, KISS Nail Products, Inc. v. Ardell International, Inc. (C.D. Cal.), filed March 31, 2025. On October 8, 2026, the docket shows an order transferring the new case as a related case (ECF No. 15).

What the patent covers

U.S. Patent 12,672,687, titled Ready-to-Use Eyelash Extensions, issued July 7, 2026, and the complaint says it is a continuation of the '288 Patent. Claim 1 covers an artificial eyelash system with a plurality of eyelash segments and a package that stores them before sale. Each segment is at most one third the width of the user's natural eyelashes and has eyelash filaments with a base and tip attached to a support strip, plus an adhesive element on the upward-facing surface placed between the bases and half the average filament length and spaced apart from the bases. The adhesive must adhere to the underside of the natural lashes without heat or additional adhesive and must be applied before the segments are packaged. (U.S. Patent 12,672,687 claim 1.)

What the lawsuit alleges

KISS alleges it owns the '687 Patent. It alleges, on information and belief, that Ardell imports and distributes the accused products and infringes at least claim 1, literally or under the doctrine of equivalents, and induces and contributes to infringement by others, with exemplary claim charts attached as Exhibits B and C. The complaint also alleges that during prosecution of the '687 Patent the examiner considered the prior art and invalidity contentions Ardell raised in the earlier case. KISS asks for a finding of willful infringement, preliminary and permanent injunctions, damages with enhancement, and attorneys' fees. (Compl. paras. 3 to 9, 49 to 70, 92 to 103; prayer.)
