The complaint

LeverageRF, a Texas limited liability company, sues Wiliot, Inc., which the complaint alleges, on information and belief, is a Delaware corporation based in San Diego, and Wiliot LTD, which it alleges, on information and belief, is an Israeli company based in Caesarea. The complaint alleges, on information and belief, that the defendants have a regular and established place of business in Plano, Texas, and pleads venue under 28 U.S.C. 1400(b) and, for the Israeli company, 28 U.S.C. 1391(c)(3). It is signed by Hao Ni of Ni, Wang & Massand, PLLC.

The patent

U.S. Patent 7,400,253, "Harvesting Ambient Radio Frequency Electromagnetic Energy for Powering Wireless Electronic Devices, Sensors and Sensor Networks and Applications Thereof," issued July 15, 2008 and names Marc H. Cohen as sole inventor. Claim 1 covers an electronic device with a control module that includes an energy harvesting controller, a tag module and a sensor module controlled by the control module, an energy harvesting module that wirelessly collects ambient radio frequency electromagnetic energy, and a power module that powers the control module from that collected energy, where the controller assesses the power needs of the tag and sensor modules, transfers power to them, and charges a local energy storage device. The complaint alleges LeverageRF owns the patent by assignment. Google Patents lists an adjusted expiration date of March 20, 2027 for the patent.

The accused products

The complaint accuses Wiliot's IoT Pixels, which it describes, on information and belief, as postage-stamp-sized printed tags that run without a battery by harvesting ambient RF energy from WiFi, cellular, and Bluetooth sources, with onboard sensors and a processor, and that broadcast an identifier and sensor data over Bluetooth Low Energy to readers or gateways for relay to Wiliot's cloud platform. It alleges direct infringement of at least claim 1, alleges that Wiliot has had actual notice of the patent and the infringement since at least March 11, 2026, when Cohen notified Wiliot, and alleges willful infringement. USPTO assignment records show an assignment of the patent from Cohen to LeverageRF executed August 2, 2026 and recorded August 29, 2026.

The relief sought

LeverageRF asks for a judgment of infringement, damages, pre-judgment and post-judgment interest, an ongoing royalty, enhanced damages for willful infringement, attorneys' fees under 35 U.S.C. 285, and an injunction against further infringement for the remaining life of the patent. LeverageRF demands a jury trial.
