The parties and the court
The case is Scoutware, LLC v. Walgreen Co., No. 5:26-cv-06236 (W.D. Tex., San Antonio Division), filed September 28, 2026. The docket shows it assigned to Judge Jason K. Pulliam. The complaint alleges, on information and belief, that Walgreen Co. is an Illinois company based in Deerfield, Illinois, and pleads venue under 28 U.S.C. 1400(b) based on Walgreens stores in San Antonio.
The patent
U.S. Patent 11,646,988, titled Verified Hypermedia Communications, issued May 9, 2023. The complaint says Scoutware is the exclusive licensee of all rights in the patent, including the right to sue for past and future infringement, that the inventor is an owner of Scoutware, and that the patent's priority date is February 24, 2016. It describes the patent as relating to communicating through unique dynamic messaging links that lead a recipient to a personalized message.
What the lawsuit alleges
The complaint alleges that Walgreens sends opted-in pharmacy customers text messages, such as refill and ready-for-pickup alerts, containing links on a recognizable Walgreens short domain with a random code that leads to a personal message about the customer's order, and, on information and belief, that Walgreens stores those messages on network-accessible devices and monitors whether customers open the links. Count I alleges that Walgreens directly infringes at least claim 6 of the '988 patent by making and using that pharmacy customer messaging system, with a claim chart attached as Exhibit E, and says Walgreens has been on notice of the patent at least since service of the complaint.
Relief sought
Scoutware asks for a judgment of infringement, a permanent injunction under 35 U.S.C. 283, damages of no less than a reasonable royalty, a finding that the case is exceptional under 35 U.S.C. 285 with attorneys' fees, interest, and costs. It demands a jury.
What to watch next
The docket shows a summons issued October 20, 2026 and returned executed October 26, and Judge Pulliam's standing order on procedure, which addresses conferring before a Rule 12(b)(6) motion. Watch for Walgreen's answer or motion to dismiss.
