On October 27, 2026, SharkNinja Operating LLC and SharkNinja Sales Company filed two 12-page design-patent complaints in the District of Massachusetts that follow the same structure: SharkNinja Operating LLC v. Kingpot Global Limited, No. 1:26-cv-14857, assigned to Judge Brian E. Murphy, and SharkNinja Operating LLC v. ERIVESS International Trading Limited, No. 1:26-cv-14854, assigned to Judge Richard G. Stearns. Each pleads a single count of direct infringement of U.S. Patent D1,091,236 under 35 U.S.C. 271(a). SharkNinja filed three more suits in the same court the same day, listed below by caption.

The design patent

U.S. Patent D1,091,236, titled Collection Tray for a Drink Maker, issued September 2, 2025, from Application No. 29/987,972, filed January 28, 2025. The patent names SharkNinja Operating LLC as applicant and assignee. Its single claim covers the ornamental design for a collection tray for a drink maker, shown in three figures; portions drawn in dashed broken lines form no part of the claimed design.

Both complaints allege that SharkNinja Operating LLC owns all right, title, and interest in the patent and that SharkNinja Sales Company, a wholly owned subsidiary, is an implied licensee. They allege that the Ninja SLUSHi line, including the Ninja SLUSHi Professional Frozen Drink Maker (model FS301), embodies the claimed design; that the product box directs buyers to sharkninja.com/patents, which lists the patent for the FS3 series; and that this public marking page has given constructive notice of the patent since at least October 25, 2025.

Kingpot and the ZABINS listing

The Kingpot complaint alleges, on information and belief, that Kingpot Global Limited is a limited company organized under the laws of Hong Kong, and alleges that public records, including the ZABINS storefront on Amazon.com (Seller ID A1V0ZSNCS7TM4I), indicate that Kingpot operates the store selling the accused ZABINS-branded products (ASIN B0FQTZ5ZZB). The complaint sets images from that listing, captured October 22, 2026, and photographs of the collection tray of a ZABINS sample purchased through the listing, taken October 22, 2026, in Needham, Massachusetts, beside the Ninja SLUSHi and its tray.

ERIVESS and the Stopasd listing

The ERIVESS complaint alleges that ERIVESS International Trading Limited is a limited company organized under the laws of Hong Kong and that public records, including the ErivessHK storefront on Amazon.com (Seller ID A1816U6AM62SJT), indicate that it operates the store selling the accused Stopasd-branded frozen drink makers (ASIN B0FWR6TFJX). The complaint sets listing images captured October 21, 2026, and photographs of the collection tray of a Stopasd sample purchased through the listing, taken October 21, 2026, in Needham, Massachusetts, beside the Ninja SLUSHi and its tray.

The count and the relief sought

Each complaint alleges that the accused products appropriate the patented ornamental design and are substantially the same in overall impression, and that the defendant has known of the patent at least since the complaint was filed. The prayer for relief in each case lists a judgment of infringement under 35 U.S.C. 271(a); preliminary and permanent injunctions under 35 U.S.C. 283 against products, including the defendant's branded products, that “embody, appropriate, or are colorably similar to the ornamental design claimed in the ’236 Patent”; and further relief the court deems just and proper. Both complaints demand a jury trial.

The three other suits

The other suits SharkNinja filed in the District of Massachusetts on October 27, 2026, are SharkNinja Operating LLC v. Guizhou Qianmangnuo Enterprise Management Co., Ltd., No. 1:26-cv-14852; SharkNinja Operating LLC v. Xiamen Shi Hai Zu Bao Dianzi Shangwu Shanghang (Geren Duzi), No. 1:26-cv-14853; and SharkNinja Operating LLC v. Xiamen Guangbohui Trading Co., Ltd., No. 1:26-cv-14856. Their public dockets show a complaint filed that day and summonses issued. The complaints in those three cases are not available for free online.

What to watch next

Watch for service on the defendants, answers or defaults, and any motion for a preliminary injunction under 35 U.S.C. 283. Watch also whether the complaints in Nos. 1:26-cv-14852, 1:26-cv-14853, and 1:26-cv-14856 become public. Any of these cases can end at any time, including by settlement or voluntary dismissal.
