The parties and the patent
The case is Shenzhen Peishi Advertising Media Co., Ltd. v. LIPOO-US, No. 2:26-cv-03326 (D. Nev.). The plaintiff is a Chinese company that says it sells automatic electronic cocktail smokers. The defendants are LIPOO-US, Goyzyqi, Tinnije, Liwuwer, qianyechuanmei, MASONVAC Direct, Enraek, FLYENG, and AGOT Direct, each named in the caption as "a Chinese entity." The body describes the defendants as individuals or business entities that operate Amazon stores under seller aliases and alleges, on information and belief, that they reside or operate outside the United States. U.S. Patent 12,324,440, Automatic Smoker, issued June 10, 2025, and the complaint says the sole inventor assigned it to the plaintiff on August 22, 2025. The complaint says the plaintiff holds the right to recover damages for infringement occurring after it acquired ownership.
What the patent covers
Claim 1 covers an automatic smoker with a smoker body, a pipe with a combustion chamber and a smoke outlet port, and a base, where the pipe is held between the detachable body and base. The body has a housing with a mounting cavity, a bottom cover with an air inlet hole, a thermal insulation cover that opens or closes the combustion chamber and has an air inlet port, and an automatic igniter whose ignition needle passes through the bottom cover into the air inlet port, with a gap between the bottom cover and the side wall of the air inlet port, and extends into the combustion chamber to ignite the combustion medium.
What the complaint alleges
The complaint alleges, on information and belief, direct infringement of at least claim 1 under 35 U.S.C. 271(a) and induced infringement under 35 U.S.C. 271(b). It pleads no pre-suit notice letter, but it alleges that the defendants acted knowingly and willfully, and the body of Count I claims punitive and exemplary damages, a request the prayer does not repeat. It says counsel ordered an accused product from each storefront for delivery to Nevada. On joinder, it cites Federal Rule of Civil Procedure 20, 35 U.S.C. 299, and In re EMC Corp., 677 F.3d 1351 (Fed. Cir. 2012), and alleges that each accused product has an ignition needle passing through the bottom cover into the insulation cover's air inlet port with a gap for airflow, and that Goyzyqi, Tinnije, Liwuwer, and Enraek share identical or near identical exterior designs and controls.
Relief requested
The plaintiff asks for judgments that each defendant directly infringed and induced infringement of at least claim 1, a permanent injunction, damages of no less than a reasonable royalty with prejudgment and post-judgment interest and costs under 35 U.S.C. 284, an accounting and supplemental damages, enhanced damages under 35 U.S.C. 284 to the extent warranted, and fees under 35 U.S.C. 285 to the extent warranted. The body of the complaint also says the plaintiff is entitled to preliminary injunctive relief, and the complaint demands a jury trial.

Court dockets show that Shenzhen Peishi has asserted the '440 patent in other suits, including Shenzhen Peishi Advertising Media Co., Ltd. v. Bufeeke Inc., No. 1:26-cv-03733 (D. Colo.), filed August 14, 2026, and No. 1:26-cv-00090 (N.D. Ill.), filed January 5, 2026. The Nevada complaint does not mention them.
