The complaint

The case is Vision Sphere Labs LLC v. Edgecore Americas Networking Corporation, No. 8:26-cv-03112 (C.D. Cal.), a 28 page complaint for patent infringement filed October 22, 2026, ECF No. 1, with the '860 patent attached as Exhibit 1. The complaint describes Vision Sphere Labs as a Texas limited liability company with a place of business in Houston, Texas, and alleges, on information and belief, that Edgecore Americas Networking Corporation is a California corporation with a place of business in Irvine, California. The docket shows a civil cover sheet, a report on the filing of a patent action, and a request for issuance of summons, all filed October 22.

Jurisdiction and venue

The complaint pleads subject matter jurisdiction under 28 U.S.C. 1331 and 1338(a). It alleges, on information and belief, that Edgecore is subject to personal jurisdiction through its business in California, including at least part of the alleged infringement, and through its Irvine place of business. It pleads venue under 28 U.S.C. 1400(b), pointing to Edgecore's California incorporation and alleging, on information and belief, that Edgecore maintains a place of business in the district and committed at least part of the alleged infringement there.

The patent and the asserted claim

U.S. Patent No. 7,990,860, Method and System for Rule-Based Sequencing for QoS, issued August 2, 2011. The complaint alleges that Vision Sphere Labs is the assignee of all right, title, and interest in the patent. It describes the patent as addressing bandwidth-constrained networks in which less important data can crowd out more important data, and quality of service approaches of the time that required support at every node, did not scale well, and classified messages by header rather than by content at the transport layer.

Claim 1 covers a method in which a processing device receives data at a data communication system on a node at the edge of a network, determines a network status from network measurements, selects a mode with a user defined sequencing rule based on that status, prioritizes and sequences the data under the selected mode's rule, determines an effective link speed or link proportion, meters inbound data by shaping and outbound data by policing, and communicates the data based on its priority, the effective link speed, or the link proportion, with the receiving and prioritizing steps occurring at the transport layer of a protocol stack.

The accused switches

The complaint names the ECS4660-28F, ECS4610-26T, ECS4610-50, ECS4110-28P, ECS4110-52P, ECS4110-52T, ECS4110-28T, ECS4210-12T, ECS4210-12P, ECS4530-54CSFP, ECS4530-54CSFP-I, ECS4125-10T, ECS4155-30T, ECS4150-28T, ECS4150-28F, ECS4150-28P, ECS4150-54T, ECS4150-54P, ECS4650-54P, ECS5520-18X, ECS5520-18T, and ECS5550-30X as accused products, without limiting the list to them. It names the ECS5520-18X as its example for claim 1 and cites Edgecore product pages and the ECS5520 and ECS4660-28F management guides on QoS class and policy maps, metering of ingress and egress traffic, and use of Layer 4 information to prioritize data, and alleges that all the accused products infringe similarly.

The count

The single count alleges direct infringement of claim 1 under 35 U.S.C. 271. It also alleges, on information and belief, that Edgecore induces and contributes to infringement by providing the switches to customers, with marketing materials showing the QoS features, and with knowledge from at least the date of service of the complaint. The indirect infringement allegations refer to claim 11 and to claim 1 of the '860 patent.

The complaint states that Vision Sphere Labs is in compliance with any applicable marking or notice provisions of 35 U.S.C. 287, and alleges that it will be greatly and irreparably harmed unless a preliminary and permanent injunction issues.

The relief sought

The prayer asks for a judgment that claim 1 was infringed, literally or under the doctrine of equivalents, damages and costs with an accounting of infringements and damages not presented at trial, pre-judgment and post-judgment interest, and other relief. The complaint demands a jury.

Other Vision Sphere Labs suits on the '860 patent

Vision Sphere Labs filed a same-day suit in the Northern District of California, No. 5:26-cv-12344, asserting the '860 patent and U.S. Patent No. 7,769,028. An earlier suit on both patents, filed in the Northern District of Texas in August 2025, is now No. 5:26-cv-00728 in the Northern District of Alabama after transfer.
