The parties and the transfer

The East Texas case is ABC IP, LLC v. William McAllister d/b/a 80% Lowers, No. 4:26-cv-01446 (E.D. Tex.). It began in the Southern District of Indiana, Indianapolis Division, as No. 1:26-cv-01170, where ABC IP, LLC and Rare Breed Triggers, Inc. filed the complaint on June 2, 2026 against William McAllister, described in the caption as an individual doing business as 80% Lowers. Venue was pleaded under 28 U.S.C. 1400(b).

On August 24, 2026 the plaintiffs filed an amended complaint, which is not available. Its docket entry lists the same five patents as exhibits. Summonses issued the next day to Tactical Gear Heads LLC, doing business as 80-Lowers.com and 80% Lowers, and to an individual, and the court's party list now names those two as the defendants.

On September 28, 2026 the plaintiffs filed a notice of multidistrict litigation in Indiana. The Indiana docket shows the case transferred to the Eastern District of Texas on October 7, 2026 under conditional transfer order 13 in In re: Rare Breed Triggers Patent Litigation, MDL No. 3176, and the East Texas docket shows it transferred in on October 8 and assigned to Chief District Judge Amos L. Mazzant.

Patents and accused products

The original complaint asserts U.S. Patents 12,038,247 (issued July 16, 2024), 12,031,784 (July 9, 2024), 12,529,538 (January 20, 2026), 12,578,159 (March 17, 2026), and 12,636,403 (May 26, 2026), one count per patent, and alleges direct, contributory, and induced infringement. It alleges that ABC IP owns the patents by assignment and that Rare Breed is the exclusive licensee. It alleges, on information and belief, that the defendant sells two products through the 80-lower.com website: the (3-Position) Super Safety, as a complete kit that includes the cam and cam lever components along with a standard AR-pattern hammer, disconnector, springs, and a modified trigger, and the (3-Position) Atrius Forced Reset Selector, as a standalone product. It alleges, on information and belief, that the Super Safety embodies all five patents and that the Atrius Selector embodies the '247, '784, '159, and '403 patents. In Counts I through IV and IX, the complaint charts the Super Safety against claim 15 of the '247 patent, claim 1 of the '784, '538, and '159 patents, and claim 38 of the '403 patent, and charts the Atrius Selector against the same claims of the '247, '784, '159, and '403 patents.

Relief sought

The original complaint asks for judgments of infringement and willfulness, preliminary and permanent injunctions, damages under 35 U.S.C. 284 with enhancement, and attorneys' fees under 35 U.S.C. 285, and the plaintiffs demand a jury.

What to watch next

The docket shows affidavits of service, filed in Indiana before the transfer, on the individual on August 31, 2026 and on Tactical Gear Heads LLC on September 3. Under the East Texas transfer-in entry, any motion pending in Indiana is moot and must be re-urged. Watch for an MDL order setting response dates and for the defendants' answers or motions.
