The parties and the transfer
The East Texas case is ABC IP, LLC v. Wojtek LLC d/b/a Wojtek Weaponry, No. 4:26-cv-01447 (E.D. Tex.). It began in the District of New Hampshire as No. 1:26-cv-00678, where the complaint was filed August 19, 2026. The plaintiffs are ABC IP, LLC, Rare Breed Triggers, Inc., and RBTM LLC. The defendants are Wojtek LLC, which the complaint alleges, on information and belief, is a New Hampshire limited liability company doing business as Wojtek Weaponry, and Nathan Wolanyk, who the complaint alleges, on information and belief, is an owner of Wojtek LLC and directs its operations. Venue in New Hampshire was pleaded under 28 U.S.C. 1400(b).
On September 29, 2026 the plaintiffs filed a notice regarding multidistrict litigation in the New Hampshire case. The New Hampshire docket shows an October 2 MDL order lifting the stay of a conditional transfer to the Eastern District of Texas because no objection was filed with the Judicial Panel on Multidistrict Litigation, and an October 7 final MDL order transferring the case under 28 U.S.C. 1407 in MDL No. 3176. The East Texas docket shows the case transferred in on October 8, 2026 and assigned to Chief District Judge Amos L. Mazzant.
Patents and accused products
The complaint asserts U.S. Patents 12,038,247 (issued July 16, 2024), 12,031,784 (July 9, 2024), 12,529,538 (January 20, 2026), 12,578,159 (March 17, 2026), 10,514,223 (December 24, 2019), 11,724,003 (August 15, 2023), 12,036,336 (July 16, 2024), 12,274,807 (April 15, 2025), and 12,636,403 (May 26, 2026). It alleges that ABC IP owns each by recorded assignment and that Rare Breed is the exclusive licensee.
The complaint alleges, on information and belief, that the defendants make or sell four products through the Wojtek Weaponry website: the (3-Position) Super Safety, accused under the '247, '784, '538, '159, and '403 patents; the Atrius Forced Reset Selector and the ARC-Fire, each accused under the '247, '784, '159, and '403 patents; and the (3-Position) Disruptor, accused under the '223, '003, '336, '807, and '403 patents. Counts I through IX take the patents one at a time. Count I alleges direct, induced, and contributory infringement of the '247 patent, including claim 15, by the Super Safety, the Atrius Selector, and the ARC-Fire, and charts claim 15 against the Super Safety, the Atrius Selector, and the ARC-Fire.
Trademark counts
Counts X through XII allege federal trademark infringement under 15 U.S.C. 1114, false designation of origin under 15 U.S.C. 1125(a), and common law trademark infringement and unfair competition. The complaint alleges that RBTM owns the FRT marks, including registrations for FRT, FRT-15, FRT-22, FRT-47, and FRT-15L3 and pending applications for FRT-MR3 and FRT-RD3, that Rare Breed is the exclusive licensee, and, on information and belief, that the defendants sell products promoted in association with the FRT marks.
Relief sought
The plaintiffs ask for judgments of infringement and willfulness, preliminary and permanent injunctions against infringing the patents and against using FRT or any FRT-formative term for firearm triggers, removal and destruction of advertising that uses the marks, damages under 35 U.S.C. 284 and 15 U.S.C. 1117(a) with enhancement, the defendants' profits, and attorneys' fees under 35 U.S.C. 285 and 15 U.S.C. 1117. They demand a jury.
What to watch next
The docket shows returns of service on both defendants, served September 1, 2026, filed in New Hampshire before the transfer. Under the East Texas transfer-in entry, any motion pending in New Hampshire is moot and must be re-urged. Watch for an MDL order setting the defendants' response date and for the defendants' answer or motion.
