The case is ATLeisure, LLC v. Sorara Outdoor Living USA, Inc., No. 1:26-cv-05010 (N.D. Ga.), filed September 1, 2026 and assigned to Judge Jean-Paul Boulee. ATLeisure says it is a Georgia limited liability company based in Atlanta that sells patio umbrellas under the ATLEISURE and SEASONS SENTRY brands. The complaint describes Sorara as a California corporation with a mailing address and business location in Atlanta, and alleges that it is a direct competitor. ATLeisure demands a jury.
The patent and the accused umbrella
U.S. Patent 8,104,492, titled Adjustable Offset Umbrella, issued January 31, 2012 from an application filed May 5, 2009. Claim 1 covers an offset umbrella with a main pole, a sliding member that can be locked at a chosen height on the pole, a canopy carried on an arm that runs from the canopy's center to the sliding member, a brace pivotably attached to the pole above the sliding member and to the arm, and a winding mechanism mounted on the sliding member whose hub winds a line running along the arm to the canopy. Turning the hub tensions or relaxes the line to open and close the canopy, and moving the sliding member along the pole changes the canopy's angle.
The complaint alleges, on information and belief, that Sorara sells offset umbrellas under the Mirador brand, including the Mirador 11.4' Cantilever Umbrella with Rolling Base listed on a national warehouse retailer's website and sold at its stores in Georgia, and it attaches a claim chart for claim 1 as Exhibit 2.
What the lawsuit is about
ATLeisure alleges direct infringement, literally or under the doctrine of equivalents. It says its counsel notified the retailer and Sorara of the alleged infringement in or about March 2026, that Sorara's counsel responded to cease and desist letters, and that any infringement after Sorara learned of the patent was willful. It asks for damages including lost profits but no less than a reasonable royalty, treble damages, an exceptional case finding and fees under 35 U.S.C. 285, and an injunction.
What to watch next
The docket shows a summons issued September 2, 2026 and a pro hac vice application for ATLeisure's out-of-state counsel. Watch for service, Sorara's answer or Rule 12 motion, and the scheduling order.
