The patents and claim 8
U.S. Patent 9,704,186 issued July 11, 2017, from an application filed March 14, 2013. U.S. Patent 10,402,874, a continuation of that application, issued September 3, 2019. Each public complaint alleges that AutoFX2 owns both patents, with the sole and exclusive right to enforce them. The complaints say the patents teach systems and methods for aggregating product information with application information to generate a commercial application for services, by collecting digital content such as a photograph or video, with location and date or time information, so a service provider can validate the product's condition.
Claim 8 of the '186 patent covers a method of capturing a photograph or video of a product with a mobile-device camera, determining geographical information associated with that content, retrieving product information from a server, generating digital content that includes the photograph or video plus metadata with geographical information and time and date characteristics representing the product's physical condition, aggregating that content with applicant information into a commercial application for services from a lending, insurance, or third-party service entity, and transmitting the commercial application to a central server so the remote entity can validate geography, time, date, and product condition before deciding on the application.
Claim 8 of the '874 patent covers a related method that captures a photograph or video, determines geographical information, retrieves product information, generates digital content with the photograph or video, geographical information, and a date characteristic representing physical condition, aggregates that content with applicant information to generate or modify a commercial application for lending, insurance, or third-party services, and transmits the product information, digital content, and applicant information to a central server for validation of geography, date, and product condition before a decision.
Assignment records
USPTO assignment records list AutoFX2 LLC, of Katy, Texas, as assignee of both patents. The '186 patent names AutoFX2 LLC as applicant and assignee. The plaintiff in all five suits is AutoFX2 Technologies, LLC, which each public complaint describes as a Texas limited liability company.
Allstate
AutoFX2 Technologies, LLC v. The Allstate Corporation, No. 4:26-cv-01541 (E.D. Tex.), names The Allstate Corporation, alleged to be a Delaware corporation, and Allstate Insurance Company, alleged to be an Illinois corporation. Venue is pleaded under 28 U.S.C. 1391 and 1400(b), including a regular and established place of business in Frisco, Texas. Counts I and II allege direct infringement, literally or under the doctrine of equivalents, of at least claim 8 of the '186 and '874 patents through Allstate mobile apps that, with Allstate servers, allow insurance claims to be made remotely. The complaint also alleges direct infringement through direction or control over customers' use of the apps, induced and contributory infringement of claim 8 of both patents, and knowledge of the patents at least as of notice of the suit. It alleges, on information and belief, that Allstate has a policy or practice of not reviewing the patents of others and has been willfully blind to AutoFX2's patent rights, and it alleges that the infringement is willful. The prayer seeks damages under 35 U.S.C. 284, including increased damages, pre-judgment and post-judgment interest, an exceptional-case finding with attorney's fees under 35 U.S.C. 285, and further relief. AutoFX2 demands a jury.
Progressive
AutoFX2 Technologies, LLC v. The Progressive Corporation, No. 4:26-cv-01545 (E.D. Tex.), names The Progressive Corporation and Progressive Casualty Insurance Company, both alleged to be Ohio corporations, and pleads a regular and established place of business in Frisco, Texas. The counts, claim 8 assertions, indirect infringement, willful blindness and willfulness allegations, prayer, and jury demand track the Allstate complaint, directed at the Progressive mobile app used with Progressive servers.
Liberty Mutual
AutoFX2 Technologies, LLC v. Liberty Mutual Insurance Company, No. 4:26-cv-01544 (E.D. Tex.), names Liberty Mutual Insurance Company, alleged to be a Massachusetts corporation, and pleads a regular and established place of business in Plano, Texas. What to watch next
Watch for answers or Rule 12 motions in the five suits, and for the GEICO and State Farm complaints to become public, which would show the patents and products at issue in those two cases. Watch also whether the cases are consolidated or coordinated. Any of the suits can end at any time, including by settlement or voluntary dismissal.
