The case is BE Labs, Inc. v. GAO Tek Inc., No. 2:26-cv-00779 (E.D. Tex.), filed September 2, 2026 in the Marshall Division and assigned to Judge Rodney Gilstrap. BE Labs says it is a New York corporation. The complaint describes GAO Tek as a Canadian corporation based in Pickering, Ontario, and pleads venue under 28 U.S.C. 1391(c) because it is a foreign corporation. BE Labs demands a jury.
The patent
U.S. Patent 7,827,581, titled Wireless Multimedia System, issued November 2, 2010 from an application filed February 28, 2001. Claim 1, which defines its own terms for packet, communicate, and broadcast, covers a customer premises system with a wireless multimedia center that receives video, audio, and broadband data signals from one or more sources and distributes segments of them to multiple end units. The video signals are broadcast over one or more dedicated RF channels using orthogonal frequency division multiplexing with pulse widths long enough to defeat multipath, reflection, and absorption losses, and the center controls which segments of which signals go to each end unit.
What the lawsuit is about
BE Labs alleges that GAO Tek directly infringes, and since service of the complaint has induced infringement of, one or more claims of the '581 patent. The complaint identifies the accused products and exemplary claims only in claim charts attached as Exhibit 2, which are not available, and alleges, on information and belief, that numerous other devices also infringe. It asks for a judgment that the patent is valid and infringed, damages under 35 U.S.C. 284, and a finding that the case is exceptional under 35 U.S.C. 285.
What to watch next
A waiver of service was filed on September 18, 2026 (ECF No. 6). Watch for GAO Tek's answer or Rule 12 motion. The related suit on the '581 and '183 patents is No. 2:26-cv-00778.
