The complaint

The case is ExactoJoin LLC v. ATP Electronics Taiwan Inc., No. 2:26-cv-00831-JRG (E.D. Tex., Marshall Division), filed September 17, 2026, ECF No. 1 (5 pages). The complaint demands a jury trial. ExactoJoin LLC, which the complaint describes as a New Mexico corporation, alleges it is the assignee of all right, title and interest in U.S. Patent 9,001,581. The complaint describes ATP Electronics as a corporation organized under the laws of Taiwan. The docket shows the case assigned to District Judge Rodney Gilstrap.

What the patent covers

U.S. Patent 9,001,581, titled Compact Semiconductor Memory Device Having Reduced Number of Contacts, Methods of Operating and Methods of Making, issued April 7, 2015, from an application filed February 11, 2014. Claim 1 recites a semiconductor memory device with a plurality of semiconductor memory cells and at least one contact that electrically connects the memory cells to at least one control line, where there are fewer contacts than memory cells, and where the device is configured to inject charge into or extract charge out of a portion of at least one memory cell to maintain that cell's state. (Compl. para. 9; U.S. Patent 9,001,581 claim 1.)

What the lawsuit alleges

ExactoJoin alleges that ATP Electronics has directly infringed one or more claims of the '581 patent by making, using, offering to sell, selling, and/or importing the Exemplary Defendant Products identified in the claim charts of Exhibit 2, and through employees' internal testing and use. Exhibit 2 charts claim 1 against an ATP Electronics industrial SD card. The complaint alleges, on information and belief, that ATP Electronics has continued to sell the products and distribute product literature and website materials that induce end users to infringe, and it alleges induced infringement at least since service of the complaint and charts. The single count seeks damages, and the prayer asks for a judgment that the patent is valid and enforceable and a finding that the case is exceptional under 35 U.S.C. 285. (Compl. paras. 11 to 18; Ex. 2; Prayer.)

ExactoJoin filed ten complaints on the '581 patent in the Marshall Division on September 17, 2026, Nos. 2:26-cv-00829 through 2:26-cv-00838, each against a single defendant and each on the same five-page form. (Complaints, ECF No. 1 in each case.)

The docket shows a summons issued on September 17, 2026. Watch for proof of service, ATP Electronics' answer or other response, and any order consolidating the ten '581 cases. Any of these cases can end at any time, including by settlement or voluntary dismissal.
