Which decisions go there?
Section 1295(a) assigns the court jurisdiction over specified district-court patent cases and decisions from the Patent Office and ITC, among other categories. A dispute involving a patent is not automatically within every part of that jurisdiction. Confirm the statutory category and whether the particular decision is appealable.
How much time is available?
The route controls. Federal Rule of Appellate Procedure 4(a) ordinarily provides 30 days for a civil district-court appeal, with different periods in specified government-party cases and rules for certain postjudgment motions. Agency review uses its own statutes and rules. Federal Circuit Rule 4 warns that the court cannot waive or extend statutory appeal deadlines.
What should the appeal plan identify?
Identify the order, issues preserved below, standard of review, and record supporting each issue. The Federal Circuit Rules of Practice address briefing, appendices, and review petitions. Do not use a general FAQ as the calculation of a deadline in a particular case.
