Why might sales information matter?
Section 284 provides compensatory damages for infringement, including at least a reasonable royalty. Section 289 provides a profit-based design-patent remedy. Product-level dates, quantities, revenue, and costs may therefore matter to a damages analysis, but a requested spreadsheet is not proof of liability or of the proper recovery.
Is a demand letter the same as discovery?
No. Civil Rule 26(b)(1) governs relevant, proportional, nonprivileged discovery in a case, and Rule 26(c) permits protective orders on the required showing. A private letter should not be treated as though a court has already ordered production. Check separately for an actual subpoena, court order, or agreement requiring a response.
What should I review before disclosing?
Clarify the products, dates, categories, intended use, and confidentiality terms. Have counsel evaluate whether a narrower or aggregated response is appropriate. Preserve the underlying records even if you dispute the request, and avoid estimating figures that cannot be checked against the business records.
