How does it differ from a private settlement?
A settlement records the parties' agreement. A consent judgment adds a court order with the terms the court enters. If the order includes an injunction, Rule 65(d) requires specificity about the acts restrained. An agreement to end a case does not necessarily include an admission of validity or infringement; read the actual terms.
What should the proposed order address?
Check the patents, claims, products, parties, time period, any admission or reservation, payment obligations, and any continuing restrictions. Distinguish what belongs in the public order from what remains a contractual obligation. Avoid assuming the label "consent judgment" supplies missing scope.
How will a later breach be handled?
Under Kokkonen v. Guardian Life, dismissal of a federal case does not by itself preserve federal jurisdiction to enforce a private settlement. Incorporation of terms, retention of jurisdiction, or an independent jurisdictional basis can matter. Settle the intended enforcement route when drafting the order and agreement.
