What does a dismissal resolve?
Rule 41 governs voluntary dismissal, including notices, stipulations, and court-ordered dismissal. Check whether the dismissal is with or without prejudice and read any stated conditions. Do not infer a finding of validity or infringement simply from the fact that a case ended.
When does an agreed order matter?
If the parties want continuing court-ordered restrictions, the proposed decree must state them clearly. Rule 65(d) requires injunctions to describe the acts restrained specifically. Identify the parties, products, conduct, and duration instead of relying on a settlement label.
Who enforces the private agreement later?
Kokkonen v. Guardian Life explains that federal enforcement jurisdiction does not automatically follow a dismissal. The court's retention of jurisdiction or incorporation of the agreement, or an independent jurisdictional basis, can matter. Resolve the enforcement plan when documenting the settlement.
