The complaint

The case is Glick Metals, LLC v. Marco Industries, Inc., No. 4:26-cv-00585 (N.D. Okla.), filed September 21, 2026, ECF No. 1 (23 pages), with a jury demand. Glick asks for damages and injunctive relief on eight counts: infringement of two utility patents and two design patents, misappropriation of trade secrets under the Defend Trade Secrets Act and the Oklahoma Uniform Trade Secrets Act, unfair competition, and unjust enrichment.

What the patents cover

The complaint asserts U.S. Patents 9,359,767 (Z-Shaped Closure Member With Filter Retention Features, issued June 7, 2016) and 9,605,435 (Z-Shaped Closure Member for Raised Seam Roofs, issued March 28, 2017, according to the complaint), and U.S. Design Patents D767,111 and D770,028 on Z-closure members. Claim 1 of the '767 Patent covers a one-piece Z-shaped closure member for mounting a vent cap on a raised seam roof, with a central member with ventilation openings, an upper flange and an upper retainer member and tab extending from it, a lower flange, and a flexible locking tab. (U.S. Patent 9,359,767 claim 1; Compl. paras. 17 to 32.)

What the lawsuit alleges

Glick alleges that it makes SNAP-Z ridge vents, that Marco representatives toured its facility in March 2020 after signing nondisclosure agreements and viewed confidential information about the equipment and process used to make its Z-shaped closure members, and that Marco later developed its Standing Seam Vent. It alleges that Marco has known of the asserted patents since at least December 2025. It alleges, on information and belief, that Marco directly infringes and induces infringement of each asserted patent and contributes to infringement of the '767 Patent, and that Marco had no explanation for its product other than misappropriation. (Compl. paras. 10 to 87; Counts I to VIII.)

What to watch next

The docket shows a notice that the case was randomly assigned to a United States magistrate judge for all purposes, with a form for declining consent (ECF No. 6). Watch for service, Marco's answer or motion, and any preliminary-injunction motion.
