The case is Lolliprops Inc. d/b/a Tempaper & Co. v. Love vs. Design, No. 4:26-cv-00102 (D. Utah). The complaint was filed September 3, 2026 under No. 2:26-cv-00822; the next day the clerk moved the pleadings to the new number and assigned the case to the court's Southern Region, where proceedings are held in St. George. It is assigned to District Judge Ann Marie McIff Allen, who on September 8 referred nondispositive pretrial matters to Magistrate Judge Paul Kohler. Tempaper says it is a New York corporation based in New Jersey. The complaint alleges, on information and belief, that Love vs. Design is a privately held Utah entity based in Washington, Utah. Tempaper demands a jury.

The patent and the accused products

U.S. Patent 8,367,176, titled Repositionable, Self-Adhesive Wallpaper, issued February 5, 2013. Claim 1, which the complaint quotes, covers a repositionable surface covering made of a vinyl sheet with a printable surface coating on the front, a removable backing layer of paper and a release agent, and a pressure sensitive acrylic emulsion adhesive between them with an alkaline pH, a minimum application temperature of +20 degrees F, a service temperature range from 0 to +150 degrees F, and listed regulatory compliances, so that the covering can be applied, removed, and repositioned or reused. The accused products are Love vs. Design's removable peel and stick wallpaper, shown on its website.

What the lawsuit is about

Tempaper alleges direct infringement of at least claim 1, literally or under the doctrine of equivalents, and induced infringement through sales to customers and retailers and through marketing and instructions, the inducement allegations made in part on information and belief. It says Love vs. Design has been on notice since a July 3, 2025 letter, refused to stop, and so infringes willfully. It asks for a permanent injunction, damages of at least a reasonable royalty, treble damages for willful infringement under 35 U.S.C. 284, and fees under 35 U.S.C. 285. Exhibit D to the complaint was filed under seal with leave of court.

What to watch next

Watch for Tempaper's response or an amended complaint and the ruling on the motion. Magistrate Judge Kohler has ordered the parties to propose a schedule.
