The complaint
Hong Kong Uking Trading Limited v. Zhejiang Hengfeng Top Leisure Co., Ltd., No. 8:26-cv-02635-VMC-SPF (M.D. Fla., Tampa Division), was filed September 10, 2026 as a thirteen-page complaint for declaratory judgment of noninfringement and invalidity, ECF No. 1, with a jury demand. The docket's assignment entry shows the case assigned to Judge Virginia M. Hernandez Covington and Magistrate Judge Sean P. Flynn. Uking filed an amended complaint on September 11, 2026 (ECF No. 5), which is not available. The original complaint alleges that Uking, a Hong Kong company, sells a Sekey-brand foldable utility wagon on Amazon through its UkingDirect storefront, and that Hengfeng, a Chinese company and the owner of record of the '178 patent, submitted an APEX complaint against the wagon on or about August 28, 2026.
What the patent covers
U.S. Patent 11,332,178, titled Foldable Wagon, issued May 17, 2022. Claim 1 covers a wagon that adjusts between expanded and collapsed configurations, with a four-sided frame in which each side is a pair of folding bar assemblies, a vertically oriented pole at each corner to which the upper leg ends connect and along which the lower leg ends slide, so that the distance between the lower and upper leg ends along each pole is greater when collapsed than when expanded; four wheels; a pliable liner defining an open-top compartment; a tow handle; and a collapsible bottom support assembly with a central hub and four bars pivotally connected to the hub and to the bottom of the poles.
What the lawsuit is about
Count I seeks a declaration of noninfringement. Uking alleges that its wagon lacks the central-hub-and-four-bar bottom support assembly required by independent claims 1 and 10 and the two-connecting-member pull handle required by independent claim 3, and says the applicant added those features during prosecution to obtain allowance. Count II seeks a declaration that every claim is invalid under 35 U.S.C. 102 and 103 over references including U.S. Patents 10,633,010, 9,211,897, and 9,073,564 and a Chinese utility model, and alleges the claims are not entitled to their March 25, 2020 Chinese priority date. The prayer also asks the court to bar Hengfeng from asserting the adjudicated claims against the wagon through APEX, to order Hengfeng to withdraw its APEX complaint, and to award attorneys' fees if the case is found exceptional.
What to watch next
A summons issued on October 13, 2026 (ECF No. 14). Watch for service on Hengfeng and its response, and for any further APEX activity tied to the '178 patent.
