The case is VeriBase LLC v. Unitech America, Inc., No. 2:26-cv-00782 (E.D. Tex.), filed September 2, 2026 in the Marshall Division and assigned to Judge Rodney Gilstrap and Magistrate Judge Roy S. Payne. VeriBase says it is a New Mexico company, and the complaint describes Unitech America as a California corporation with an established place of business in Cypress, California, and pleads venue under 28 U.S.C. 1400(b). VeriBase demands a jury.
The patent
U.S. Patent 9,600,661, titled System and Method to Secure a Computer System by Selective Control of Write Access to a Data Storage Medium, issued March 21, 2017 from an application filed December 1, 2005. Claim 1 covers a method of controlling write access to a mass data storage device: a first process running in kernel mode alongside the operating system monitors storage accesses and detects when a separate application tries to write to the device; the method then checks a rules database that lists applications and an access level for each, and allows or blocks the write depending on the access level assigned to that application.
What the lawsuit is about
VeriBase alleges that Unitech America directly infringes, and since service of the complaint has induced infringement of, one or more claims of the '661 patent. The complaint identifies the accused products and exemplary claims only in claim charts attached as Exhibit 2, which are not available, and alleges, on information and belief, that numerous other devices also infringe. It asks for a judgment that the patent is valid and infringed, damages under 35 U.S.C. 284, and a finding that the case is exceptional under 35 U.S.C. 285.
Status
An answer and counterclaim were filed for Unitech America on September 24, 2026 (ECF No. 8). The parties filed a stipulation of dismissal on October 5, 2026 (ECF No. 11), and the court entered an order dismissing the case on October 7, 2026 (ECF No. 12).
What to watch next
The case is closed. VeriBase's same-day suits on the patent, No. 2:26-cv-00781 and No. 2:26-cv-00780, remain open.
