The complaint
Volteon LLC v. Advanced Navigation Pty Ltd, No. 2:26-cv-00975 (E.D. Tex., Marshall Division), is a five-page complaint filed October 29, 2026, with a jury demand. It describes Volteon as a corporation organized under Texas law with its principal place of business in Marshall, Texas, and Advanced Navigation as a corporation organized under the laws of Australia with an established place of business in Sydney. It pleads personal jurisdiction based on business activities and alleged acts of infringement in the district, and venue under 28 U.S.C. 1391(c) because Advanced Navigation is a foreign corporation.
The patent
The complaint alleges that Volteon is the assignee of all right, title, and interest in U.S. Patent 9,782,637, which issued October 10, 2017 from an application filed December 14, 2016. It asserts the exemplary claims identified in the claim charts of its Exhibit 2.
Claim 1, the patent's first claim, recites a device for signaling in response to a sensed motion that has, in a single enclosure, an accelerometer producing an output signal responsive to the device's acceleration; an electric motor for affecting a physical movement; software and a processor, coupled to the accelerometer and the motor, for activating or controlling the motor in response to the accelerometer's output; a rechargeable battery that powers the device; and an induction coil that receives AC power inductively in an electromagnetic field to charge the battery.
The accused products
The complaint accuses the Exemplary Defendant Products identified in the Exhibit 2 claim charts, which it incorporates by reference. It alleges, on information and belief, that numerous other devices that infringe the patent have been made, used, sold, imported, and offered for sale by Advanced Navigation or its customers, and it alleges that Advanced Navigation's employees internally test and use the exemplary products.
The count and relief
Count 1 alleges direct infringement, literally or under the doctrine of equivalents, by making, using, offering to sell, selling, or importing the exemplary products. It also alleges induced infringement since service of the complaint and charts, which the complaint says give Advanced Navigation actual knowledge of the alleged infringement, and it alleges, on information and belief, that Advanced Navigation distributes product literature and website materials that induce end users to use the products in the way it says infringes. Volteon asks for judgments that the patent is valid and enforceable and has been infringed directly and indirectly, an accounting of damages not presented at trial, damages under 35 U.S.C. 284 with interest and costs, and, if necessary, a declaration that the case is exceptional under 35 U.S.C. 285 with an award of attorneys' fees.

Volteon is also the plaintiff in other suits in the Eastern District of Texas, Marshall Division, including No. 2:25-cv-00881, filed August 26, 2025, Nos. 2:26-cv-00534 and 2:26-cv-00535, filed July 1, 2026 (No. 2:26-cv-00535 was dismissed in July 2026 after a notice of voluntary dismissal), and No. 2:26-cv-00984, filed October 30, 2026, according to those dockets.
