The complaint

The case is Werner Co. v. FrenchCreek Production, Inc., No. 1:26-cv-00269 (W.D. Pa.), a 23-page patent complaint filed September 25, 2026, ECF No. 1, with a jury demand. Werner, a Delaware corporation, asserts four patents against FrenchCreek, which it alleges, on information and belief, is a Pennsylvania corporation. The accused products are the 1772 Reusable Concrete Hole Anchor and substantially similar products.

What the patents cover

The complaint asserts U.S. Patents 12,129,880 and 12,129,152 (both issued October 29, 2024), 11,807,499 (issued November 7, 2023, according to the complaint), and 11,446,526 (issued September 20, 2022, according to the complaint). Claim 1 of the '880 patent covers an expansion bolt with a base, elongate members ending in spoons (at least one formed in one piece with its spoon), a central shaft ending in a wedge that enters a cavity formed by the spoons so the members move outward, and a ring element that swivels about the shaft's long axis. Claim 1 of the '152 patent covers a similar bolt whose members bend outward, and adds a swivel attachment for the ring and a biasing member, with the shaft extending up through the swivel attachment to the top of the bolt. Claim 1 of the '499 patent, as the complaint describes it, covers a pivot and swivel mechanism with a ring element, a swivel housing, and a capping element, and claim 1 of the '526 patent an expansion bolt with a housing member. (U.S. Patents 12,129,880 and 12,129,152 claim 1; Compl. paras. 10 to 13, 23, 36, 52 to 56, 66 to 68.)

What the lawsuit alleges

Werner alleges it owns the asserted patents, notified FrenchCreek of infringement on or around April 27, 2026, and that FrenchCreek has made, used, sold, offered, or imported the accused products. Counts I to IV allege infringement of claim 1 of each patent, allege that the infringement after notice has been willful, and ask for an injunction, damages, and related relief. (Compl. paras. 14 to 16, Counts I to IV.)
